Terms and Conditions KRAMIS-Shop
1. scope of application
The General Terms and Conditions (hereinafter referred to as "GTC") apply to all orders placed and contracts concluded via the KRAMIS Shop. Kramis Teppich Design AG reserves the right to change the GTC. The version of the GTC valid at the time the order is placed shall apply and may not be unilaterally changed for this order.
2. offer
The offer is directed to natural customers with residence or legal customers with registered office in Switzerland & Liechtenstein. Deliveries will only be made to addresses in Switzerland.
The offer is valid as long as it is visible in the KRAMIS Shop and/or as long as stocks last. Prices and assortment are subject to change at any time. The images shown in the KRAMIS store and all information about the products are for illustrative purposes and are not binding.
3. price
Prices are quoted in Swiss francs, including value added tax (VAT). The price in the KRAMIS-Shop at the time of the order is decisive.
4. order
The presentation of the products in the KRAMIS Shop is not a legally binding offer, but a non-binding online catalog or a non-binding invitation to the Customer to order the product in the KRAMIS Shop.
An order is deemed to be an offer to Kramis Teppich Design AG to conclude a contract.
After the order has been submitted, the customer automatically receives a confirmation of receipt documenting that the order has been received by Kramis Teppich Design AG.
Kramis Teppich Design AG is free to reject orders in whole or in part without giving reasons. In this case, the customer will be informed and any payments already made will be refunded. Further claims are excluded, in particular there will be no forwarding of undeliverable products. Temporarily unavailable products can not be reserved.
5. payment options
Payments must be made in Swiss francs.
Credit cards, bank transfers and Twint are accepted as means of payment. The available means of payment are displayed in the KRAMIS store.
The debit will be made immediately.
Purchase on account is not possible.
6 Conclusion of contract
A contract is not concluded until the order has been processed by Kramis Teppich Design AG. As soon as the order is ready for shipment, the customer will receive an information by mail.
7. delivery
The delivery address of the customer must be in Switzerland.
No deliveries will be made on weekends and official national or cantonal holidays.
If the customer is not present at the time of delivery and has not given special delivery instructions, the delivery man will leave a pick-up invitation in the mailbox. The clientele must then pick up the delivery at the appropriate post office.
Any order not picked up within the specified time limits will not be held or refunded. Customers are solely responsible for orders picked up late and any claims for defects are excluded.
The customer will be asked to additionally confirm their collection by their signature. Any liability for damages incurred by the customer due to loss, theft, misuse, etc. in connection with the pick-up process or the pick-up slip is expressly excluded.
The customer assumes responsibility for the delivered products, even if they were not directly received by him.
8. delivery costs
The delivery costs are a flat rate of CHF 10. The delivery costs communicated in the KRAMIS store shall apply. The delivery costs are listed as an additional item in the shopping cart and on the invoice.
9 Warranty
Kramis Teppich Design AG may provide warranty either by partial or complete replacement with an equivalent product.
10. returns
The buyer bears the costs for returns. Returns must be arranged in advance with Kramis Teppich Design AG (info@kramis-teppich.ch).
11. notice of defects
If products are delivered with obvious damage to the packaging or contents, the customer must immediately complain to the delivery messenger and refuse acceptance, without prejudice to his rights regarding defects. The customer is obligated to obtain a damage confirmation report from the delivery carrier. All transport damages must also be reported immediately to Kramis Teppich Design AG.
12. transfer of risk
The risk shall pass to the buyer as soon as the consignment has been handed over to the person carrying out the transport. If the shipment is delayed or becomes impossible through no fault of our own, the risk shall pass to the buyer upon notification of readiness for shipment. An assumption of the transport costs by Kramis Teppich Design AG agreed in individual cases has no influence on the transfer of risk.
13. limitation of liability
Claims for damages arising from impossibility of performance, breach of contract, culpa in contrahendo and tort are excluded against us as well as against our vicarious agents, except in cases of intent or gross negligence. Any liability for consequential damages resulting from the use of the products is rejected.
14 Applicable court and place of jurisdiction
Altbüron is the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship. The legal relationship is subject to Swiss law.
